Booking Terms & Conditions

Thank you for choosing Frame The Moment.

These Terms & Conditions are designed to ensure a clear and enjoyable experience for both you (“the Client”) and Frame The Moment (“the Photographer”).

By paying the booking fee, the Client confirms that they have read, understood and accepted these Terms & Conditions.

1. Booking & Booking Fee

A session is confirmed once the date and time have been agreed and the €50 non-refundable booking fee has been received.

The booking fee secures the session date, covers administration and planning, and is deducted from the final balance.

The booking fee is refundable only if the Photographer is unable to provide the agreed service and rescheduling is not possible.

2. Payment

The remaining balance, together with any additional images or optional add-ons, must be paid in full before the final gallery is released for download.

3. Rescheduling

If the Client needs to reschedule, the Photographer should be contacted as soon as possible.

One complimentary reschedule may be offered, subject to availability. Repeated rescheduling or very short notice may require a new booking fee.

If the Client does not attend the session without prior notice, the booking fee will be forfeited and a new booking fee will be required to book another date.

Reasonable efforts will always be made to accommodate genuine emergencies and unexpected circumstances.

4. Cancellation

If the Client cancels the session, the booking fee is non-refundable.

If the Photographer is unable to provide the session due to illness or unforeseen circumstances, an alternative date will be offered where possible. If rescheduling is not possible, all payments received will be refunded.

5. Weather

Outdoor sessions are subject to suitable weather conditions.

If conditions are unsuitable, the Photographer may postpone the session to the next mutually convenient date at no additional charge.

6. Session Duration

Session durations shown on the website are approximate.

Sessions are not rushed, particularly when working with babies, children or pets, but they are not unlimited in length. The Photographer will conclude the session once the planned experience has been completed and sufficient images have been created.

7. Health, Safety & Responsibility

The safety and wellbeing of everyone involved is always a priority.

Parents or legal guardians remain responsible for supervising their children throughout the session.

Pet owners remain responsible for the supervision, behaviour and safety of their animals and for any injury or damage to property caused by their animal.

The Photographer may stop or postpone a session if continuing would create a safety risk.

If anyone attending has a contagious illness, the Client should inform the Photographer as soon as possible so the session can be rescheduled if necessary.

8. Client Responsibilities

The Client agrees to arrive on time, provide accurate information relevant to the session, inform the Photographer of delays and follow reasonable safety instructions.

All participants are expected to behave respectfully throughout the session.

9. Creative Style & Editing

By booking, the Client confirms that they are familiar with the style of Frame The Moment as presented in the Photographer's portfolio.

The Photographer retains creative control over posing and guidance, lighting, composition, image selection and editing.

Standard editing includes adjustments to colour, white balance, exposure, contrast and cropping, together with subtle, natural retouching where appropriate.

Extensive alterations, including body or facial reshaping, changing body proportions, excessive skin retouching, background replacement, composite images, or digitally adding or removing people,  are not included.

The Photographer is not responsible for permanent features of a location that are outside reasonable control, such as furniture, radiators, walls, buildings or fences.

Additional editing requests may be considered individually and may incur an additional charge.

Only photographs that meet Frame The Moment's quality standards will be delivered.

10. Image Selection & Gallery Delivery

The Client will choose their favourite photographs from a private online gallery containing professionally edited images selected by the Photographer.

Not every photograph taken during the session will be presented or delivered.

Additional images may be purchased according to the current pricing.

The gallery will normally be delivered within approximately two weeks of the session. During particularly busy periods, delivery may take longer, in which case the Client will be informed.

11. Digital Files & RAW Files

Final photographs are supplied as professionally edited high-resolution JPEG files.

RAW files are the Photographer's working files and are not supplied.

Colours may vary between devices, screens and print laboratories. The Photographer is not responsible for changes in image quality or colour resulting from screenshots, social media compression, third-party editing or printing through non-professional laboratories.

12. Gallery Availability & Backup

The private online gallery will remain available for three months from the delivery date.

The Client is responsible for downloading and safely storing their photographs before the gallery expires.

Long-term storage is not guaranteed. Although backup copies may occasionally be retained, photographs may be permanently deleted after this period without further notice.

13. Copyright & Personal Use

All photographs remain the copyright of Frame The Moment.

The Client receives a personal, non-exclusive licence to download, print, share with family and friends, and publish the photographs on personal social media.

Photographs may not be sold, licensed to third parties, used commercially, entered into competitions, used for advertising or promotional purposes, or significantly altered without the Photographer's written permission.

Cropping for social media is permitted, but filters or edits that significantly alter the Photographer's original editing style are not.

14. Cooperation & Results

Every session is unique, and the Photographer will make every reasonable effort to create a varied and beautiful final gallery.

Specific poses, expressions or reactions from babies, children or pets cannot be guaranteed.

The final results may also depend on the cooperation and participation of those attending the session.

15. Liability

The Photographer will take reasonable care in providing the agreed photography services.

In the event of equipment failure, illness, accident or other circumstances beyond reasonable control that prevent completion of the agreed service, the Photographer's liability will be limited to the total amount paid by the Client.

Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded or limited, or any statutory rights or remedies available to the Client under Irish consumer protection law.

16. Force Majeure

Neither party will be responsible for delay or failure to perform their obligations where this results from circumstances beyond their reasonable control.

17. Acceptance

By paying the booking fee, the Client confirms that they have read, understood and accepted these Terms & Conditions.
